These Website Terms and Conditions ("Terms") govern your use of https://acme.example (the "Site"), which is operated by Acme Inc., doing business as Acme ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About the Site

The Site is not intended to create a professional, contractor-client, guide-client, or other service relationship by itself. A service relationship begins only when the parties complete any required review and enter into a separate agreement, booking confirmation, work order, or other written acceptance.

You may use the Site only for lawful purposes and in accordance with these Terms. If you use the Site on behalf of a business or organization, you represent that you have authority to act on its behalf.
3. Information, availability, and changes
We try to keep Site information accurate and current, but information may be incomplete, outdated, or contain errors. Services, service areas, schedules, pricing, promotions, qualifications, and availability may change without notice. Images may be examples and may not show the exact result available for a particular project or service.
We may modify, suspend, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.
4. Quote requests, inquiries, and bookings
Submitting a contact form, quote request, appointment request, or similar inquiry does not obligate us to accept work, reserve a date, provide a service, or honor a proposed price. Unless we clearly state otherwise in a separate written offer:
- Site pricing and estimates are informational only.
- A quote is not final until we confirm its scope, assumptions, price, and validity period in writing.
- A booking or project is not accepted until all required approvals, signatures, deposits, or other stated conditions are completed.
- Additional terms may apply to the actual service, including payment, cancellation, refund, safety, access, weather, warranty, and liability terms.
If a separate agreement conflicts with these Terms regarding the purchased or booked service, the separate agreement controls for that service.
5. No professional advice
Site content is provided for general informational purposes. It is not legal, tax, accounting, medical, engineering, safety, financial, or other regulated professional advice. You should obtain advice from an appropriately qualified professional when your circumstances require it.
6. Your submissions
If you send us text, files, photographs, plans, reviews, feedback, or other material through the Site, you represent that:
- The submission is accurate to the best of your knowledge.
- You have the right to provide it.
- It does not infringe another person's rights or violate the law.
- It does not contain malicious code.
You retain ownership of your submission. You give us permission to use, copy, and share it as reasonably necessary to respond to your request, evaluate or provide requested services, operate our business, comply with law, and protect our rights. This permission does not authorize us to use your private project materials in public marketing without any additional permission required by law or agreement.
Do not send confidential, export-controlled, regulated, or highly sensitive information through a general Site form unless we specifically provide an appropriate secure method.
7. Intellectual property
The Site and its original content, design, graphics, logos, photographs, text, software, and other materials are owned by us or used with permission and are protected by intellectual property laws.
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for your personal or internal business evaluation. Except as permitted by law or with prior written permission, you may not copy, reproduce, modify, distribute, sell, license, publicly display, remove ownership notices from, or create derivative works from Site content.
Names, logos, and trademarks belonging to third parties remain the property of their respective owners.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Acme Inc. AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US, IF ANY, SPECIFICALLY FOR ACCESS TO THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not exclude liability that cannot lawfully be excluded or limited. They apply only to Site use and do not replace liability terms in a separate agreement for paid services.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Acme Inc. and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, costs, and reasonable attorneys' fees arising from your unlawful use of the Site, your material violation of these Terms, or content you submit that infringes another person's rights.
14. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer law, legal proceedings relating to the Site must be brought in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms by posting a revised version on this page and changing the "Last updated" date. Changes apply prospectively when posted unless applicable law requires additional notice.
16. Severability and waiver
If a provision of these Terms is held unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of the right to enforce it later.
17. Entire agreement for Site use
These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding use of the Site. They do not replace a separate agreement governing services, bookings, purchases, or projects.
